1. Agreement
These Terms of Service (“Terms”) are a contract between you and Scoop Systems, Inc. (“Luna”, “we”, “us”). They govern the Luna Baby app, the Luna Baby Plus subscription, Sleepy Time, and the Luna online service the app connects to when you sign in (together, the “Service”). By installing or using the app, creating an account, or purchasing a subscription you agree to these Terms and acknowledge our Privacy Policy, which explains how we handle information. If you do not agree, do not use the Service.
2. Who may use Luna Baby
You must be at least 18 years old and able to form a binding contract to create an account or purchase a subscription. Luna Baby is designed for parents and caregivers recording the care of a child in their care. You are responsible for having the authority to record and share information about that child.
3. Accounts and households
You may use the app without an account; your records then stay on your device. To synchronize, share with caregivers or subscribe to Plus, you sign in with Apple or Google. Your account belongs to a household. The person who creates a household is its owner and controls who else may join, what they may see, and the household’s subscription. Keep your Apple or Google credentials secure; you are responsible for activity under your account. Tell us promptly at support@hellolunababy.com if you believe your account has been used without permission.
4. License to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Luna Baby app on Apple-branded devices that you own or control, as permitted by the App Store usage rules, for the purpose of recording and understanding your child’s care. The app and the Service, including their software, design, text, artwork, icons and trademarks, are owned by Luna or our licensors and are protected by intellectual-property laws. Open-source components are listed in the app’s third-party notices and remain under their own licenses.
You may not copy, modify, distribute, sell, rent, reverse engineer or attempt to extract the source code of the app except where the law expressly permits it or an open-source license grants it; remove any proprietary notices; use the Service to build a competing product; or access the Service by any means other than the app.
5. Luna Baby Plus subscription
Luna Baby is free to use for core care tracking, timers, reports and on-device Sleepy Time. Luna Baby Plus (shown in the app as “Luna+”) unlocks the features the app labels as Plus for your whole household, including support for multiple children, using the household on more than one phone at a time, inviting caregivers into your household, and the full-day sleep plan. Plus features may change over time as described in section 10.
Plans and prices
Plus is offered as an auto-renewing subscription in the App Store subscription group “Luna Baby Plus”, in two plans: Monthly (one month per period) and Annual (one year per period). The price of each plan is shown in the app and on the App Store for your country, in your local currency, before you confirm the purchase; prices are set per storefront and may include applicable taxes. There is currently no free trial or introductory offer; if we add one, the app will state its length and the price that applies afterwards before you buy.
Billing and automatic renewal
Payment is charged to your Apple ID when you confirm the purchase. Your subscription renews automatically at the end of each monthly or annual period at the then-current price for your plan, and your Apple ID is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before it ends. Apple may notify you in advance of a price increase and, where required, ask for your consent before the increased price applies.
Cancelling
You can cancel at any time in your iPhone’s Settings → Apple ID → Subscriptions, or through the “Manage” button on the Luna Baby Plus screen in the app, which opens the same Apple screen. Cancellation stops future renewals; you keep Plus until the end of the period you already paid for. Deleting the app does not cancel a subscription.
Refunds
Purchases are made from Apple, and refunds are handled by Apple under the App Store terms. You can request a refund at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves. If Apple refunds or revokes a purchase, Plus features end for your household.
Household entitlement
Plus is attached to the household of the account that purchased it and benefits every caregiver in that household. Only the purchasing account can change or cancel the subscription. If the purchaser leaves the household or deletes their account, Plus ends for the household at the end of the paid period. Restoring purchases on a new device requires signing in to the same Apple ID and Luna account.
Lapses
If a renewal payment fails, Apple may retry for a period during which Plus may remain available. If the subscription expires, the app returns to the free tier: you keep all of your records, reports and on-device features, but Plus-only features become unavailable until you subscribe again. We never delete your records because a subscription ended.
6. Your records
You own the information you record in Luna Baby. So that we can provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, copy, transmit, back up, display and process your records solely to operate, secure and improve the Service for you and the caregivers you authorize, and as described in the Privacy Policy. This license ends when your records are deleted from the Service, except for copies that remain in routine encrypted backups for a limited time or that we must keep by law. We do not use your records to train machine-learning models, and we do not sell them.
You can export your records at any time from Settings → Data & Privacy. You are responsible for keeping copies of any export you save or share outside the app.
7. Sharing with caregivers
When you invite a caregiver you decide which children they can see and record for. Share invitation links or codes only with people you trust; anyone who redeems a link joins your household with the scope you set. Caregivers may add, edit and delete records for the children in their scope, and those changes are visible to the whole household. The household owner may change a caregiver’s scope or remove them at any time. Each caregiver is responsible for their own use of the Service under these Terms.
8. Not medical advice
Luna Baby, Sleepy Time and any guidance, estimate, chart or plan in the app are informational tools that help you observe patterns in the care you record. They are not medical advice, diagnosis or treatment, they are not a substitute for the judgment of a pediatrician or other qualified professional, and they are not a safety, breathing or sleep monitor. Estimates may be wrong, incomplete or unavailable, and they depend entirely on the accuracy and completeness of what you record. Always follow safe-sleep guidance from your health authority, and contact a medical professional or emergency services for any concern about your child’s health. Never delay seeking care because of something you saw in the app.
9. Acceptable use
You agree not to use the Service to break the law; to record information about a child you are not authorized to care for; to upload malicious code or interfere with the Service, other users or our providers; to probe, scan or test the Service’s security without written permission; to create accounts by automated means or to circumvent limits; or to impersonate anyone. We may suspend or end access that violates these Terms.
10. Changes to the service and these terms
We are continually improving Luna Baby and may add, change or remove features, including which features are part of Plus. If we materially reduce what Plus includes during a period you have paid for, you may cancel your subscription and ask Apple for a refund at reportaproblem.apple.com; Apple decides refund requests under the App Store terms. We may change these Terms; when we do, we will update the date at the top and, for material changes, tell you in the app before they take effect. Continuing to use the Service after a change means you accept the new Terms.
11. Ending your use
You may stop using the app at any time and may delete your account from Settings → Data & Privacy → Delete account, which also ends any household you are the last owner of. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service, in which case we will give reasonable notice and a chance to export your records where the law or circumstances allow. Sections 6 (as to retained backups), 8, 12, 13, 15 and 16 survive termination.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and any warranty that the Service will be uninterrupted, error-free or secure. Some jurisdictions do not allow these exclusions, so some may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Luna and its officers, employees and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from or related to the Service, even if advised of the possibility. Our total liability for all claims relating to the Service in any twelve-month period will not exceed the greater of the amount you paid us for Plus in that period and USD 50. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or the statutory rights of consumers in your jurisdiction.
14. Apple App Store terms
Because the app is distributed through Apple’s App Store, the following applies in addition to the rest of these Terms:
- These Terms are between you and Luna only, not Apple. Apple is not responsible for the app or its content.
- Your license is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Luna, not Apple, is solely responsible for maintenance and support of the app. Apple has no obligation to furnish any maintenance or support services.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Luna’s responsibility.
- Luna, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar legislation.
- If a third party claims that the app infringes its intellectual-property rights, Luna, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the app, for example your wireless carrier’s terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you.

15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction whose mandatory consumer law applies to you, that law governs to the extent it gives you rights you cannot waive, and you may bring proceedings in the courts of your place of residence. If a dispute arises, please contact us first so we can try to resolve it informally. Otherwise, any claim must be brought in the state or federal courts located in California, and you and Luna consent to their jurisdiction, unless the law where you live requires otherwise.
If you are a consumer in the European Economic Area or the United Kingdom, you have a 14-day right to withdraw from a subscription purchase. By starting to use Plus immediately after purchase you ask us to begin providing it during that period and acknowledge that the right of withdrawal ends once the service has been fully provided; Apple, as the merchant of record, handles withdrawal requests under the App Store terms.
16. General
These Terms, together with the Privacy Policy and any additional terms shown in the app or the App Store, are the entire agreement between you and Luna about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the Service. Notices to you may be given in the app or through the App Store.
